Вступило в законную силу решение суда, которым удовлетворены требования прокурора города Арсеньева о признании незаконным начисление платы (с корректировкой) за услуги по отоплению и горячему водоснабжению, предоставляемые филиалом «Арсеньевский» КГУП «Примтеплоэнерго».
В связи с обращениями жителей города Арсеньева прокуратурой города проведена проверка законности начисления филиалом «Арсеньевский» КГУП «Примтеплоэнерго» платы (с корректировкой) за услуги по отоплению и горячему водоснабжению, в ходе которой выявлены нарушения действующего законодательства.
По результатам проверки прокурор города обратился в суд с заявлением в защиту прав двух пенсионеров с требованием признать незаконным произведенный им за декабрь 2010 года перерасчет (с корректировкой) за коммунальные платежи и исключить из лицевого счета необоснованно начисленной платы в размере 8 тыс. 98 рублей 90 копеек.
Решением суда исковые требования прокурора к КГУП «Примтеплоэнерго» в лице филиала «Арсеньевский» удовлетворены в полном объеме.
По итогам апелляционного рассмотрения жалобы ответчика, указанное решение суда оставлено без изменения, сообщает пресс-служба прокуратуры Приморского края.
